General provisions

The terms of this user agreement requires that your content:

Will not infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy;

Will not violate any laws, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair

Will not be defamatory, trade libelous, unlawfully threatening, unlawfully harassing, or unlawful in any way;

Will not be obscene or contain pornography;

Will not be obscene or contain child pornography or, if otherwise harmful to minors;

Will not contain any viruses, trojan horses, worms, time bombs, cancel bots or other computer programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data, or personal information;

Will not link directly to or include descriptions of goods and services that you do not have a right to link to or include

Will not include unreasonable distribution of mass e-mails to parties who do not wish to receive such e-mails or have not affirmatively acknowledged that they wish to receive such e-mails.

Mass Mailings / Spam

No level of spam distribution by e-mail is tolerated and any such conduct will result in your account being shut down.
You must not use the MITWI.COM Network or MITWI.COM and/or equipment to originate the transmission of spam, flames, mail bombs, or substantially similar, unsolicited email messages.

A message is considered unsolicited if it is sent to a recipient who has not requested or invited the message or if it is posted in violation of a newsgroup charter. For purposes of this provision, merely making one's email address accessible to the public will not constitute a request or invitation to receive messages. If you are found to have spammed, without warning, MITWI.COM reserves the right to disable your Domain without notice. We pull first, ask questions later.

MITWI.COM reserves the right to refuse service or to cancel service to known spamer without notice.

MITWI.COM reserves the right to determine what violates this policy. As such, any violation will result in cancellation of services without refund.

Any work required by our staff to repair our systems after any spam will be billed at the hourly rate then in force.

Hosting clients who run opt-in mailing list software or other collection methods for their website must require subscriber authentication before completing the process for the end user. Additionally, clear instructions on subscription and un-subscription options must be provided in each email that is sent to the mailing list recipients and also provided in a clearly marked area on the clients website.

MITWI.COM may ask you for personally identifiable information such as your name, your company's name, your telephone number, email address, zip or postal code, country, etc. in various form on our web site. MITWI.COM uses the information it gathers for several purposes, such as to submit required contact information related to domain name registrations, and to communicate with you if necessary. MITWI.COM may email its users periodically to inform them about the status of, or upcoming changes to the site, or to inform them about changes to our privacy policy. In addition, MITWI.COM may email a user at any time regarding issues with his/her account.

MITWI.COM does not send promotional, or commercial emails to its users without permission. We do not and will never rent, sell, or in any way make available such personal information to third parties (except of course where required by law, see our policy on legal investigations below) or in any other way misuse the information you provide. No unsolicited email will ever be sent to our customers. Customers may at any time cancel their accounts (see the Unsubscribe section below).

MITWI.COM will NEVER ASK YOU for your PASSWORD. See User ID, Passwords & Access Controls section below. Under no circumstances are your to divulge your password to anyone, even to a person claiming to represent MITWI.COM

Public Forums

This site makes forums, message boards, and/or news groups available to its users. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information or email address.

User Contributed Content

All of the user contributed content of this site, including files, posts, comments, and ratings is the property of MITWI.COM, and is protected under local and international copyright laws. None of the material may be reproduced without our written permission, with the exception of downloading or printing a single copy for yourself for offline viewing.

MITWI.COM reserves the right to republish the material contributed by our users. By posting a message, you expressly grant the right to MITWI.COM to republish or sell the message as part of our edited compilations or otherwise. We'll provide proper attribution to the author for any post we republish.

Users must not contribute material that is copyrighted, or that have licenses prohibiting redistribution. Users violating these terms shall be immediately and permanently banned from the site, and their identity may be revealed to appropriate authorities in harmony with our policy on legal investigations below.

Unsubscribe

This site gives customer and other subscribed users the option of unsubscribing or cancelling their account. Doing so removes their information from our servers, removes their web sites, email addresses etc, halts their ability to login, and prohibits us from contacting them in the future. Customers can cancel their account by the method described by clicking here and other Users can unsubscribe by clicking on the unsubscribe link.

User ID, Passwords & Access Controls

You are provided with a user identification number ("UserID") and a password. It is Your obligation and Your responsibility to safeguard the confidentiality and monitor any usage or Services provided in connection with the UserID and the password. Your are responsible for any and all use of the access credential assigned to you. In particular, any charges associated with the UserID and the password are Your responsibility and You shall bear any risk of loss thereto (including charges for Services).

Use of System / Server Resources

Your use of all scripts, background running programs, background Daemons, custom software, email services etc is under the condition that your use of these does not adversely affect the Server performance or the Network security / integrity. Any program, script or email configuration the is deemed to be adversely affecting Server performance or Network security / integrity may be shut down without prior notice.

Any customer whose use of the service uses a high amount of Server resources (such as, but not limited to CPU Time, Memory Usage, and Network Resources) will be given an option of either upgrading their service level or reducing the resource used to an acceptable level.

The use of items that may be deemed in contravention of this section of the agreement (except for items affecting system security / integrity) may only be allowed with the express prior consent of MITWI.COM MITWI.COM will consider requests on a Per Application Basis. If allowed, extra charges will be assessed based on resource requirements for system maintenance.

Additional Terms

	MITWI.COM reserves the right to refuse service to anyone.
	MITWI.COM is not responsible for the Content of our clients.
	MITWI.COM does not undertake to monitor or prevent any inappropriate use of this system. This includes but not limited to underage persons, or persons acting under false pretenses.
	MITWI.COM does not undertake to monitor or prevent Users from registering with false demographic information.
	MITWI.COM is not responsible for damage or loss, (data, financial, or otherwise) caused by errors in the system or the Internet. The system may be unavailable unexpectedly as a result of errors or circumstance beyond our control.
	Downloads:
	Generally speaking files downloaded from the internet carry a measure of risk. It must be stressed that we do our absolute best to protect you and your computers. Files uploaded to our site are virus scanned before being made available for download and all files are virus scanned daily, always with the latest virus signatures. In addition we automatically quarantine and review content based on member feedback. Despite all those efforts, there is no guarantee that all files downloaded from our web site is 100% safe. MITWI.COM is not liable in anyway for any negative results as a result of downloading and or using files from our web site, especially files submitted by third parties.

Billing Policies

Not withstanding anything that may appear to indicate otherwise, any other method of payment other than Credit Card & PayPal are at the sole discretion of MITWI.COM and such other methods of payment are NOT VALID until such time that they are expressly permitted by specific communication to that effect from MITWI.COM.

You agree that the services being purchased from MITWI.COM are pre-paid services and fees paid for services, regardless of term subscription length will not be refunded.

MITWI.COM provides service on a pre-paid, basis only. Terms are "Due in advance" and you become indebted for fees and/or service on your service renewal date. If payment is not received, your account and all services will be suspended. All files and emails stored on the account will be deleted after 60 days if payment is not received for amount owing or an alternative method of payment is agreed with our billing department.

Under no circumstance will we issue refunds for domain names or SSL certificates or any other thing that have been purchased or renewed on your behalf by MITWI.COM - regardless of the date of cancellation.

Credit Cards

In cases were credit card payment is the agreed method of payment, then, as a condition to your right to use the Service, You must provide us with a valid credit card which you have been authorized to use by the owner, with available credit sufficient to pay the applicable Service Fees. In the event that this credit card is cancelled, frozen, or it is otherwise not in a position to pay the relevant fees, you must immediately provide us with a new valid credit card number, that meets the requirements of this agreement. You authorize MITWI.COM, its Agents or other persons acting on our behalf, from time to time, to undertake steps to determine whether the credit card you have provided to us is a valid credit card. In the event that you do not provide us with a current valid credit card with sufficient credit upon request during the effective period of this Agreement, you will be in violation of this Agreement, and we may terminate this Agreement with You.

In order for continuity of service, you authorize MITWI.COM to charge your credit card for any outstanding moneys owed for your services on your billing renewal date. Any questions regarding the billed amount must be indicated through our contact form within 30 days of receipt of statement or acceptance of charges will be considered final.

Solely in order to comply with the payment provisions of this Agreement for the Services, You agree to allow MITWI.COM, at our discretion, to perform a credit check on You and You agree to provide MITWI.COM with either: (a) the credit or debit card particulars as described in this Agreement and to authorize MITWI.COM to charge applicable Charges to such credit or debit card; (b) if applicable, other forms of payment such as cash or check.

Alternate arrangements may be made should your credit card have any problems. Please contact our billing department at support@MITWI.COM or 631-657-4166 if you require alternate arrangements. Clients who have purchased annual services will receive a reminder email 30 days prior to the end of their "year" as advance notice of the upcoming renewal.

Cancellation of Service

We must receive your cancellation request in writing either by email to support@MITWI.COM or by fax to 1-631-657-4166. MITWI.COM will not accept cancellations by phone. A representative from MITWI.COM's Billing Department will process the cancellation during business hours. Billing Department hours are Monday through Friday, 8:00 A.M. to 4:00 PM Atlantic Time.

To cancel your service before it's renewed for another cycle, written cancellations must be received by MITWI.COM a minimum of eight (8) days prior to the end of your current billing cycle. Cancellations submitted later than this time may result in automatic renewal of your service. Unless otherwise requested, cancellations will be effective at the end of your current billing cycle.

MITWI.COM does not monitor, and will not automatically cancel accounts for issues related to non-usage, domain name transfers, lapsed domains, or any other issues not directly related to MITWI.COM services. Cancellation of services does not relieve the customer from paying any outstanding balance owed, or unbilled overages incurred on the account. MITWI.COM reserves the right to cancel any account, without notice.

Pricing

All prices are subject to change. MITWI.COM reserves the right to alter and change the Pricing Schedule at any time, upon one months prior notice to Customers. Notice may include, but is not limited to, emails sent to the registered email address of the customer, or a notice placed conspicuously on our web site. You agree that failure to cancel your subscription for Services with us after notification of any changes to the Pricing Schedule shall constitute notice to MITWI.COM that You have agreed to the terms of the Pricing Schedule.

Legal Investigations

MITWI.COM will cooperate with all Legal & Government authorities, international organizations and other law enforcement authorities on any matter and users pledge to comply with all applicable laws in such investigation. Privacy is of fundamental importance to MITWI.COM, who will respect and protect the privacy of Users. Private information will be disclosed to law enforcement authorities only as required by law.

MITWI.COM will not knowingly host illegal content if such content is determined to be illegal by a court of competent jurisdiction. Although MITWI.COM is unable to monitor all content, MITWI.COM will make a reasonable effort to investigate legitimate complaints about alleged illegal content or network abuse, and will take appropriate action. Prior to taking any action, upon receipt of such complaints MITWI.COM will: (a) conduct an internal review to determine the nature and location of the content or abuse, and where warranted; (b) consult with legal counsel and/or outside authorities, and/or; (c) notify the User or Users of the complaint, with a request for a response within seven days. If the complaint concerns copyright infringement, MITWI.COM will comply with all copyright laws of applicable jurisdictions and reserves the right to remove such offending item or Content at any time.
